In _The __Critical Advantage_, noted scholar and early childhood expert William T. Gormley, Jr. takes a wide-ranging look at the important role of critical thinking in preparing students for college, careers, and civic life. Drawing on research from psychology, philosophy, business, political science, neuroscience, and other disciplines, he offers a contemporary definition of critical thinking and its relationship to other forms of thinking, including creative thinking and problem solving. Gormley argues for prioritizing critical thinking skills in PreK–12. The science of ecology has sensitized us to the intricate causal chains in nature and to the threat to the life system posed by environmental misuse. Responding to the data provided by environmental science, some philosophers have called for fundamentally new ethical principles—a recognition of nonhuman values and an extension of rights not only to animals but to inanimate parts of nature. These attempts to develop an ecological ethic call for radical conceptual revision of the way in which most persons (...) perceive man and the world. Since our visual perception of physical things essentially involves our identifying objects by their colours, any theory of visual perception must contain some account of the colours of things. The central problem with colour has to do with relating our normal, everyday colour perceptions to what science, i.e. physics, teaches us about physical objects and their qualities. Although we perceive colours as categorical surface properties of things, colour perceptions are explained by introducing physical properties like reflectance profiles or dispositions to (...) cause certain experiences in normal human perceivers. Hence, it seems as if colours as they are experienced by us have no place in the physical world, because they are fundamentally different from the properties which we ascribe to physical objects in scientific accounts of colour perceptions. This Article is a socio-legal analysis of the California State Bar lawyer discipline system. The article draws on legal professions theory, legal ethics, legal history, and cultural analysis, and it is based on archival data, interviews with State Bar actors, and empirical data on the Bar's disciplinary system. The article examines the historical and cultural context of a perceived crisis in California State Bar lawyer discipline in the 1980s and 1990s and concludes that, while the crisis stemmed from demonstrable organizational (...) ineffectiveness in the lawyer discipline system of the State Bar, it also needs to be understood as part of a larger--and recurring--crisis of professionalism in the legal profession.The article also examines the Bar's response to the discipline crisis and argues that, contrary to the bar's harshest critics (and critical professions theory), the reforms initiated by the Bar and imposed by the state legislature improved the lawyer disciplinary system in California. Nevertheless, the article concludes that organizational and structural factors identified in this study limit the effectiveness of any system of lawyer self-regulation. (shrink)

This article is part of a Symposium that examines the legal and policy issues raised by the Schwarzenegger bobblehead doll litigation, in which a Hollywood star-turned-governor sued under California's right of publicity laws and under federal copyright law to stop a small Ohio company from selling a bobblehead doll depicting Schwarzenegger in a business suit, with a bandolier of bullets, and brandishing an assault rifle. The article contends that defendants' unauthorized use of the Schwarzenegger image on dolls and their accompanying (...) packaging was permissible as First Amendment-protected free speech under California's right of publicity laws and also constituted fair use under federal copyright law. The article rejects the argument that a First Amendment defense to plaintiff's right of publicity claims was unavailable because a bobblehead doll is not a "traditional" medium of expression for ideas. The article recognizes that overly expansive assertions of rights of publicity and other intellectual property rights threaten to stifle creative expression and diminish the cultural commons. The article also calls for clearer and more consistent recognition of defenses to right of publicity claims, particularly for cases where a defendant's unauthorized appropriation of another's image or likeness is for purposes of caricature, parody, or satire¿especially where the image is that of a politician. It concludes that the settlement of the Schwarzenegger bobblehead doll case illustrates how "strategic" assertions of even objectively non-meritorious rights of publicity can allow powerful plaintiffs to censor unflattering depictions of them and to unduly expand intellectual property rights without full adjudication on the merits of such claims.This insight is critical, because while other scholars have suggested that the "over-protection" of intellectual property rights (including rights of publicity) has a deleterious effect on freedom of expression and the public domain, these criticisms focus almost exclusively on published appellate cases. Yet, as this article reminds us, most cases settle and never become litigated cases, much less published appellate decisions. And most disputes - including intellectual property disputes - never result in formal litigation in the first instance. As with most other areas of the civil disputing process, intellectual property disputes are processed in the "shadow of the law", where repeat players have strategic advantages to shape the outcomes of disputes in their favor. Thus, if we want to know whether intellectual property rights are over-protected, we need to know what happens (and why) in the shadow of intellectual property law. This insight is the basis for the author's empirical research-in-progress focusing on "strategic intellectual property enforcement" by owners of trademarks, copyrights, and patents, including enforcement that never results in litigation and is thus under the radar of what most legal scholars in this area of law examine. As scientific and engineering efforts become increasingly global in nature, the need to understand differences in perceptions of research ethics issues across countries and cultures is imperative. However, investigations into the connection between nationality and ethical decision-making in the sciences have largely generated mixed results. In Study 1 of this paper, a measure of biases and compensatory strategies that could influence ethical decisions was administered. Results from this study indicated that graduate students from the United States and international graduate students (...) studying in the US are prone to different biases. Based on these findings, recommendations are made for developing ethics education interventions to target these decision-making biases. In Study 2, we employed an ethics training intervention based on ethical sensemaking and used a well-established measure of ethical decision-making that more fully captures the content of ethical judgment. Similar to Study 1, the results obtained in this study suggest differences do exist between graduate students from the US and international graduate students in ethical decision-making prior to taking the research ethics training. However, similar effects were observed for both groups following the completion of the ethics training intervention. (shrink)

Michael Polanyi was one of the great figures of European intellectual life in the 20th century. A highly acclaimed physical chemist in the first period of his career who became a celebrated philosopher after World War II, Polanyi taught in Germany, England, and the United States and associated with many of the leading intellects of his time. His biography has remained unwritten partly because his many and scattered interests in a wide variety of fields, including six subfields of physical chemistry, (...) epistemology, economics, patent law, social and political theory, aesthetics, and theology. Recent work on Imre Lakatos’s missing Hungarian dissertation on the historical sociology of science sheds new light on his mature philosophy of science. Remembered primarily as an “internalist” defender of the autonomy of science, and a Cold Warrior in poli­tics, commentators have mistaken his contribution as primarily a rearguard action against the followers of Thomas Kuhn and the “externalists” influenced by Boris Hessen. It comes as a surprise, then, to find that he developed and retained a fully general soci­ology of (...) scientific knowledge, with Marxist roots that articulated Lenin’s “inexhaustible atom.” He carried forward this emphasis on the fallible, changing, and incomplete nature of our engagement with the natural world by a dialectical account of how research programs advance and recede historically. In his effort to develop a synthesis of Popper and Kuhn, and via his engagement with Paul Feyerabend, he continued to develop a distinctly dialectical ap­proach to science. (shrink)

Abstract:This study tests the usefulness of a person-situation interactionist framework in examining the willingness of a salesperson to lie to get an order. Using a survey of 389 salespersons, our results demonstrate that organizational relationships influence willingness to lie. Specifically, salespersons are less willing to lie to their own company than to their customer, than to a channel partner, and finally, than to a competitor firm. Furthermore, respondents from firms with a clear and positive ethical climate are less willing to (...) lie. Finally, our study finds that interactions between personality factors, such as high Machiavellianism and high self-monitoring, and situational factors have an impact on willingness to lie. Our results suggest that firms can take steps to influence employee ethical behavior. (shrink)

Key to Steve Fuller’s recent defense of intelligent design is the claim that it alone can explain why science is even possible. By contrast, Fuller argues that Darwinian evolutionary theory posits a purposeless universe leaving humans with no motivation to study science and no basis for modifying an underlying reality. I argue that this view represents a retreat from insights about knowledge within Fuller’s own program of social epistemology. I argue for a Darwinian picture of science as a product of (...) cultural evolution building upon biological capabilities and liabilities bequeathed to us by biological evolution. Dual Inheritance or Gene-Culture Coevolution Theory can help us understand how complex social institutions emerged out of distinct, if connected, processes of biological and cultural evolution. Only by understanding how the unnatural nature of modern science emerged through cultural evolution can we consider where modern science functions well or poorly. (shrink)

The article examines and extends work bringing together engineering ethics and Science and Technology Studies, which had built upon Diane Vaughan’s analysis of the Challenger shuttle accident as a test case. Reconsidering the use of her term “normalization of deviance,” the article argues for a middle path between moralizing against and excusing away engineering practices contributing to engineering disaster. To explore an illustrative pedagogical case and to suggest avenues for constructive research developing this middle path, it examines the emergence of (...) green chemistry and green engineering. Green chemistry began when Paul Anastas and John Warner developed a set of new rules for chemical synthesis that sought to learn from missed opportunities to avoid environmental damage in the twentieth century, an approach that was soon extended to engineering as well. Examination of tacit assumptions about historical counterfactuals in recent, interdisciplinary discussions of green chemistry illuminate competing views about the field’s prospects. An integrated perspective is sought, addressing how both technical practice within chemistry and engineering and the influence of a wider “social movement” can play a role in remedying environmental problems. This dissertation is an attempt at harmonizing hermeneutics. In particular, what I term the normative and descriptive approaches are explored and brought together. A normative approach is one concerned with providing the correct method for gaining knowledge of the meaning of a text. Beardsley's normative method of relying on the "text itself" is considered and rejected. Hirsch's normative method of relying on authorial intention is considered, criticized, and used as a springboard to my own normative method of urinterpretation. Propaedeutic to (...) the articulation of urinterpretation is an answer to the question: What is an author? After a survey of theories of authorship, I propose my own author construct--the urauthor. In constructing the urauthor we go back as far as possible to the model of the original. In urinterpretation we seek authorial intention on the basis of the urauthor. It is argued that through this method we secure the meaning of a text. ;Descriptive hermeneutics is concerned with describing the phenomenon of interpretive understanding. It eschews questions of epistemological method, which are at the center of a normative approach, in favor of an ontology of interpretive understanding. Gadamer's Truth and Method is the most complete philosophical account of descriptive hermeneutics to date, and accordingly our attention to descriptive hermeneutics is largely a critique of Gadamer's work. It is argued that both normative and descriptive hermeneutics can and should coexist, but to facilitate scholarship each should be explored separately. ;Interpretation and criticism are also harmonized. Interpretation is understood as the project of seeking the meaning of a text. The meaning of a text, it is argued, is discovered by seeking authorial meaning through the urauthor. Criticism is understood as the project of seeking the significance of a text. The significance of a text, it is argued, is its meaning-as-related-to: to me, to you, to our time, etc. The harmonization of interpretation and criticism is briefly explored in typical philosophical, literary, theological, and legal texts. The alleged emergence of a ‘post-truth’ regime links the rise of new forms of social media and the reemergence of political populism. Post-truth has theoretical roots in the interdisciplinary field of Science and Technology Studies, with sociologists of science arguing that both true and false claims should be explained by the same kinds of social causes. Most STS theorists have sought to deflect blame for post-truth, while at the same time enacting a normative turn, looking to deconstruct truth claims and (...) subject expertise to criticism. Steve Fuller has developed a positive case for post-truth in science, arguing that post-truth democratizes science. I criticize this argument and suggest an alternative approach that draws on the prehistory of the field in the 1930s and 1940s, when philosophers and sociologists sought to define the social conditions necessary for reliable knowledge production that might stem mass media irrationalism.
